Getting in a car accident is one of the scariest things a person can go through. With so much going on in your life, suddenly being struck by another car and feeling the pain, both physical and emotional, that comes along with that can be a very distressing experience. Tip #1: Document Your Experience

In most cases, the police will come to the scene of a car accident and take notes as to what happened that day. However, you shouldn’t depend on the police report to tell you everything that happened. Make sure you do what you can to document the night as you remember it. Take pictures of your car before it was moved from the site of the accident. Take pictures of your own bruises or injuries. Write down what you remember from the event. This information will be very valuable to you later.

Tip #2: Go to the Doctor

You might not know whose insurance is in charge of getting things taken care of as far as injuries go, but if you are in pain, you shouldn’t just wait for someone else to give you the okay to get care. Make sure you take care of yourself as you go about dealing with the car accident aftermath. Save any documents or prescriptions that your doctor might give you because you will most likely be able to get compensation for whatever money you spend, and if the doctor deems you worthy of surgery or other invasive procedures, then you could get compensation for that as well.

Tip #3: Talk to a Lawyer

There are a lot of things that you will have to deal with that might not make sense to you. Call a lawyer who understands personal injury laws. They can give you the help you need to get everything cleared up.

Tip #4: Be Honest

While it might be tempting to try and piece together what happened that night after you hit yourself on the head, there is no good that could come from making up the story. If you don’t remember, tell the insurance people and police representatives that you don’t remember.

Tip #5: Take it Easy

You may want to just go back about your daily life as if nothing had happened, but you need to take care of your injury before you can do that. If you end up hurting yourself even more by neglecting the harm that has come upon you, you may disqualify yourself from a settlement.

In Rupp v. Moffo, LeBaron & Jensen defended the rights of a single mom against the Chapter 7 Bankruptcy Trustee who was trying to stick her with a debt that she did not owe. See Summary below. Stephen W. RUPP, Trustee, Appellee, v. Angie MOFFO, Appellant. Case No. 20130377. Decided: August 14, 2015 Angie Moffo lived rent free for eight years in a home owned by her brother-in-law, Doug Rich. After Rich filed for Chapter 7 bankruptcy, the appointed bankruptcy trustee, Stephen Rupp, filed suit against Moffo for back rent under Utah’s Uniform Fraudulent Transfer Act, asserting that Rich had defrauded his creditors by allowing Moffo to live in the house rent free after he became insolvent. The district court concluded that Moffo was the recipient of a fraudulent transfer and entered a $34,200 judgment against Moffo. The Supreme Court vacated the judgment entered against Moffo, holding that Rich did not transfer an asset to Moffo within the scope of the Act because the home was fully encumbered by a mortgage, and any rents were not the property of Rich. Remanded with instructions to enter summary judgment in favor of Moffo.

Driving is dangerous enough without the multitude of distractions available to people at any time. Most states have outlawed cell phone use while driving, due to the exorbitant amount of accidents caused by cell phone use. Although cell phones are the first thing we think of when we think about distracted driving, they are not the only causes.

Causes of Distracted Driving

Distracted driving consists of anything that diverts your attention from the road. Even reading billboard advertisements or playing road trip games can distract the driver. Here are some of the most common causes of distracted driving:

  • Eating or drinking while driving
  • Messing with the stereo or GPS
  • Talking or texting on a cell phone
  • Talking with passengers in the car
  • Putting on makeup while driving

Any non-driving activity can serve as a distraction, which can endanger both you and others on the road. Take care to avoid distracted driving, drowsy driving, and especially drunk driving. There can be severe consequences for causing an accident due to your own inattention or negligence.

Just because a device is hands-free, or even installed by the manufacturer, does not make it safe to operate while driving. Your whole concentration should be on the road the entire time while operating a vehicle.
